Comprehensive Guide: Appendix 11 Nominal Membership
In Maharashtra Cooperative Housing Societies (CHS), sub-letting or renting a flat is strictly governed by Model Bye-law No. 20 and Bye-law No. 43(b) under the Maharashtra Co-operative Societies (MCS) Act 1960. Appendix – 11 is the mandatory statutory application that tenants, licensees, or caretakers must submit to obtain Nominal Membership.
Statutory Fee Limit
The entrance fee for a nominal member is statutorily fixed at ₹100/- only. Societies cannot charge thousands of rupees under the guise of tenant admission or registration fees.
Police Verification Mandatory
Under Mumbai/Maharashtra Police directives and Bye-law 43, a copy of the Police Information / Tenant Verification acknowledgement and registered agreement must accompany the Appendix 11 form.
Non-Occupancy Charges Rule
As per Government Order under Section 79A, Non-Occupancy Charges (NOC) collected from the flat owner cannot exceed 10% of the regular service charges (excluding property tax).
